What is a Bench Warrant?

Posted by Corey L. Scott | Jun 12, 2022 | 0 Comments

A bench warrant is a court order for the arrest of an individual who has failed to appear for a scheduled court appearance. A judge may issue a bench warrant if an individual does not show up for their trial, hearing, or other required court appearance.

What is an Arrest Warrant?

An arrest warrant is a court order authorizing the police to arrest an individual suspected of committing a crime. An arrest warrant is usually issued after a grand jury indictment or when there is probable cause to believe that an individual has committed a crime. Probable cause generally means that there is evidence that suggests that the individual has committed a crime. Once an arrest warrant is issued, the individual named in the warrant can be arrested by the police.

The main difference between a bench warrant and an arrest warrant is that a bench warrant is issued when an individual fails to appear for a scheduled court appearance, while an arrest warrant is issued when there is probable cause to believe that an individual has committed a crime. Additionally, bench warrants are usually issued by a judge, while arrest warrants are usually issued by a grand jury or prosecutor. Both types of warrants are court orders that authorize law enforcement to take someone into custody.
